Failing to pay fine leads to court

Fourteen people have been prosecuted by Swale Borough Council for littering in the borough.

The cases were taken to court by the council after each had been caught dropping litter, and had been issued with a Fixed Penalty Notice (FPN).

Despite reminder letters and a summons to attend court being sent to the defendants, they each failed to pay the FPN, and were fined by magistrates.

Cllr Nicholas Hampshire, deputy cabinet member for environment and rural affairs at the council, said:

"Most people are responsible and don’t drop litter, but unfortunately, a small minority do, and expect others to pay for their mess to be cleaned up.

"We are working hard to continue to inform people that if we catch them, they will be fined.

"Any surplus from the fixed penalty notice scheme is spent on things like new bins and education initiatives, which we hope will encourage people to help keep the borough clean."

These defendants each received a fine of £220 and were ordered to pay a victim surcharge of £30, and costs of £205:

Another case was taken to court under the waste duty of care legislation, where the householder failed to ensure that their waste was taken away by an authorised carrier. A Smith, of Faversham pleaded guilty to a charge under Section 34 of the Environmental Protection Act 1990 and was fined £50, ordered to pay a victim surcharge of £40, and costs of £100.

The cases were heard at Medway Magistrates Court on 19 November 2018.
