Vigo Lane Appeal

On the 6^th August 2024 the Swale Borough Council Planning Committee (the Council) as Local Planning Authority (LPA) made a resolution to refuse the planning application (ref: 23/502210/FULL) for the development of a solar farm at the site known as Land On Either Side Of Vigo Lane And Wrens Road Sittingbourne Kent ME9 8LA.

The Appellant, Industria Solar Vigo Ltd, has appealed against the Council’s decision to refuse the application for planning permission for the development. The appeal is due to be heard at a Public Inquiry starting on 5^th August 2025.

The appeal submission included amendments to the plans that were the basis of the Council’s decision. These amendments are referred to as ‘Option 2’. The Option 2 proposal was reported to Swale Borough Council’s Planning Committee on 22 May 2025, where the Committee advised the following:

“It can be concluded that the amendments to the proposal are sufficient to make the proposal acceptable. The Planning Committee were aware that this would form the basis of the Council’s position at the appeal in relation to the amended proposals. The conditions recommended in the original Committee Report (Appendix A) would be provided to the Planning Inspectorate with minor updates where necessary to reflect the relevant updated drawings and documents.”

Now that the application is at appeal, the decision on whether to approve or refuse the application will need be made by the Planning Inspectorate following a public inquiry.
