Removing Vegetation Yourself

Under law, property owners have the right to prune overhanging branches or encroaching roots back to their property boundary. However, this right is subject to specific legal restrictions and environmental protections.

Property owners must not prune beyond the exact vertical boundary line of their property, as cutting back further is considered criminal damage. In addition, they do not have an automatic right to enter the neighbour's land or lean over the boundary to perform the work. All activities must be conducted from within the property unless permission is granted.

The timber, fruit, and foliage of a tree belongs to the tree owner and should be offered back to them. If the tree owner doesn't accept them, it is the responsibility of the property owner to dispose of the waste responsibly.

If you leave cuttings you’ve removed on our land and we don’t accept them, you could receive a fine for fly-tipping.
